Requesting an EHC needs assessment

Asking the council to formally assess

If SEN Support isn't enough, you or the school can ask the local authority to carry out an EHC needs assessment — the formal gateway to an EHC Plan.

Your rights: Parents, young people aged 16–25, or schools/colleges can request an assessment (s.36, Children and Families Act 2014).

Common pitfall: A refusal to assess is itself appealable to the SEND Tribunal — many parents don't realise this and simply give up.

Your voice: Your written request carries the same legal standing as one from the school. Don't wait for the school to act — you can make this request yourself.

• Write to the council's SEN team requesting an assessment — keep a copy and proof of sending

• Gather evidence: school reports, outside assessments (EP, SALT, OT), examples of work

• Note the date — the council has 6 weeks to decide whether to assess
